I. INTRODUCTION
Canisius College includes among its goals to “educate the whole person by caring for the intellectual, spiritual, emotional, and physical well being of each individual.”  It is the position of Canisius College to promote informed choices about the use of alcohol and drugs on and off-campus by all members of the community.  

Members of the College community are subject to all federal, state, county and municipal laws and ordinances as well as College regulations and policies regulating the possession, use, sale, and purchase of alcoholic beverages and drugs.  Students must be at least 21 years of age to consume or possess alcohol on Canisius College property.  Furthermore, the use, possession or distribution of illegal drug-related paraphernalia, narcotics or other controlled substances except as expressly permitted by federal, state and/or local law is prohibited. The misuse of prescription drugs and other products being used other than intended is also prohibited.

Since the responsible use of alcohol by those of legal drinking age is permitted, the following policies and procedures apply for the possession, use, sale, purchase, and service of alcoholic beverages.

II. GENERAL
1. Engaging in activities that promote irresponsible drinking (e.g. drinking games, chugging contests, or any means where alcohol is consumed as part of a competition) is not permitted.
2. Public intoxication and/or drunken behavior, which result in the destruction
of property, or actions that are disrespectful of the campus community, is prohibited.
3. Open alcohol containers are not permitted in public areas of the College, nor may open containers of alcohol be transported on College property.
4. Alcohol at athletic events is strictly prohibited, except at events held at the HSBC Arena, which shall be governed strictly by Arena policy.  Any violation of Arena policy shall be considered a violation of the Canisius College policy.
5. No consumption or possession of alcoholism beverages will be permitted on buses or other transportation to or from on-campus or off-campus events.
6. Possession and/or use of false identification for the purpose of, but not limited to, obtaining alcohol or gaining access to an establishment that serves alcohol, is a violation of this policy.
7. Providing alcoholic beverages to any person who is under 21 years of age is prohibited.

III. SPECIFIC
A. RESIDENCE LIFE

1. No large quantities of alcohol are permitted including, but not limited to, beer balls and kegs.  Any person found responsible for possessing a beer ball or keg shall be removed from residence.
2. Delivery of alcohol by a retail or wholesale distributor to any College housing facility is prohibited.
3. Alcohol containers used as decorations may be deemed as proof of consumption and are prohibited.

B. EVENTS
Guidelines for public and private student-sponsored social events at which alcohol will be served:
1. The event must be registered with and approved by CP&LD by way of the Program Agreement Form (to include all necessary signatures) 14 days prior to the event.
2. Only the Canisius College Dining Service is allowed to provide alcohol for on-campus events.  The only exception to this shall be if the alcohol is donated to the group sponsoring the event.  Prior to the event, written verification of the donation must be provided to CP&LD and Director of Dining Service.
3. The advisor, or his or her designee, must be in attendance for the entire event.  The advisor has the authority to terminate any function if College policies are not followed.
4. CP&LD must approve any advertising of an event that intends to include alcohol. Advertising should not promote over-consumption of alcohol or irresponsible drinking.
5. Public Safety must be contacted at least 14 days prior to the event to determine if an officer (or officers) is required.  The Director of Public Safety and CP&LD will make this determination.  A charge will be assessed for any Public Safety personnel needed.  The officer/officers on duty have the authority to terminate the event if any College policies are not followed.
6. Any organization involved in the distribution of alcohol has the responsibility for maintaining the sobriety of its participants.  At events where alcoholic beverages are available, direct access to these beverages shall be limited to (a) TIPS (Training for Intervention Procedures for Serving of Alcohol) trained server(s).  The sponsoring organization is responsible for paying for this service.  Arrangements can be made through CP&LD.
7. If the function includes the sale of alcoholic beverages at an on-campus area not covered by the College’s liquor license, an appropriate permit must be obtained from the New York State Liquor Authority.
8. Consumption of alcoholic beverages is permitted only within the approved area designated for the event.
9. At all events at which alcoholic beverages are served, the sponsoring group must provide (1) non–alcoholic beverages, and (2) a substantial amount of food, especially foods which are low in salt, consistent with the number of anticipated guests.
10. No raffles of alcohol will be permitted.
11. At all off-campus functions, the sponsoring organization shall work with the host establishment to ensure the enforcement of the 21-year-old drinking law.  A statement to this effect must appear on the signed contract made between Canisius College and the host establishment. 
**There may be events (i.e., Bills games, Bisons games, etc.) at which alcohol is
being sold.  The advisor/College representative shall determine whether or not those students who are of legal drinking age may consume alcohol in a responsible manner.  Any irresponsible behavior shall result in that privilege being revoked immediately and disciplinary action may be taken.
12. All membership recruitment functions (e.g. fraternity, sorority rush, departmental clubs, and special interest groups) shall be alcohol free.
13. Those attending functions on campus are prohibited from bringing alcohol into those events.

IV. ADJUDICATION PROCESS
Anyone in violation of this policy shall be held accountable for their behavior through the College’s established Community Standards.In addition, alcohol or drugs possessed in violation of this policy are subject to confiscation. 

All monies collected as a result of individual or group fines shall be placed into the Dean of Students budget specifically for the administration of alcohol education programs. 

The decision to notify parents of violations of the Alcohol and Drug Policy will be at the discretion of a College official.  This decision shall be based upon the following considerations: 
 • Seriousness of the incident
 • Previous disciplinary history
 • Best interest of the student.

SMOKING POLICY
Canisius prohibits tobacco use, in any form, in all indoor areas and public areas on campus.  Indoor and public areas also include, but are not limited to, restrooms, all campus buildings and college owned housing, private offices, vestibules, entrances, exits, stairwells, college owned vehicles and the Demske Sports complex. Tobacco use is limited to areas outside entrances and exits providing doors, windows, and air intake vents are closed. Smokers must extinguish cigarettes and cigars in smoking receptacles located throughout the campus.

Canisius encourages all users of tobacco, in any form, to quit. Information on smoking cessation programs are available in the Student Health Center.
